Terms of Service
These Terms of Service ("Terms") govern your use of the NW Peak Fundraising platform and services operated by NW Peak Fundraising and Consulting LLC, an Oregon limited liability company.
Platform Access
Access to the NW Peak platform is arranged directly with NW Peak. There is no separate license fee or setup fee. NW Peak's compensation is the platform fee on donations described below. Engagement terms are provided in writing before any commitment.
Platform Fees
A 6% platform fee is applied to donations processed through the platform, calculated on the donation amount the donor selects — never on any fees the donor chooses to cover. This fee covers payment infrastructure, donor-side disclosure, compliance, platform development, and operator-led support, and is NW Peak's entire and sole share of donations. Stripe's payment processing fee (approximately 2.9% + $0.30 per card transaction; 0.8% capped at $5 for bank payments where offered) is charged separately by Stripe at cost. At checkout, donors are given the option — pre-selected, always itemized in exact dollars, and always theirs to decline — to cover both fees; when they do, the school receives 100% of the donation. Example: on a $100 donation where the donor covers the fees, the school receives the full $100; where the fees are not covered, the school receives approximately $90.80. Recurring gifts bill at the cadence the donor authorizes at checkout, and donors can cancel any recurring gift themselves at any time via the link in every receipt — cancellation is effective immediately for future charges. Raffle ticket sales, where offered, carry no percentage platform fee.
Charitable Fundraising & Oregon Compliance
NW Peak Fundraising and Consulting LLC is registered with the Oregon Department of Justice as a professional fundraising firm (PF-1811) under Oregon's charitable solicitation law, ORS 128.801–128.898. Registration with the Oregon Department of Justice does not constitute or imply endorsement by the State of Oregon (ORS 128.891). Where the law requires it, NW Peak files the required solicitation notice with the Oregon DOJ before a campaign solicits, and observes the statutory waiting period. The beneficiary program receives and controls all donated funds in its own Stripe account — NW Peak never takes custody of donations, and its compensation is the disclosed platform fee only. Raffles, where offered, are conducted only for eligible Oregon organizations under Oregon's charitable gaming rules (ORS chapter 464; OAR chapter 137, division 25): Oregon purchasers only, age 18 or older, paid by bank transfer (ACH) only.
School Responsibilities
Schools are responsible for obtaining appropriate consent from athletes, parents, and guardians before creating athlete accounts. Schools must comply with FERPA and applicable state student privacy laws. Schools are responsible for the accuracy of program and athlete information entered into the platform.
Prohibited Use
You may not use the platform for any unlawful purpose, to harass or harm others, to submit false information, or to attempt to access other users' accounts. Violations may result in immediate termination of platform access without refund.
Payouts
Donations are processed as Stripe destination charges settled to the school's own Stripe Connect account: funds route to the school's account as each donation is made — not held until a campaign closes — and Stripe pays out to the school's bank on the account's payout schedule (typically daily, with standard settlement times). Schools must complete Stripe Connect onboarding before accepting donations. NW Peak is not responsible for delays caused by Stripe or banking institutions.
Text Messaging (SMS) Terms
By opting in to text messages from NW Peak Fundraising (sent on behalf of your school or program), you agree to receive registration and account notifications, program updates, fundraising campaign updates, and event or raffle confirmations at the mobile number you provided. Consent is not a condition of registration or purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for assistance; you may also contact bbailey@nwpeakfundraising.org. Carriers are not liable for delayed or undelivered messages. Mobile numbers and opt-in data are never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how your information is handled.
Limitation of Liability
NW Peak's liability to any school or user is limited to the total fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Intellectual Property
The NW Peak platform, P.E.A.K. System methodology, manuals, and all related materials are the intellectual property of NW Peak Fundraising and Consulting LLC. Use of the platform grants use rights only — not ownership.
Governing Law
These Terms are governed by Oregon law. Disputes shall be resolved through binding arbitration in Oregon, except that either party may seek injunctive relief in Oregon courts.
